Momtaz ICT – Terms of Service

1. Introduction

These Terms of Service ("Agreement") are entered into by and between Momtaz Information & Communication Technology ("Momtaz ICT," "we," "us," or "our"), operating under the name "Momtaz ICT," and you ("Customer," "you," or "your"). By using any Momtaz ICT services, you agree to be bound by this Agreement.

This Agreement applies to all services provided by Momtaz ICT, including but not limited to: domain registration and management, web hosting, custom websites, WordPress hosting, SSL security, professional email services, Google Workspace (business/education), Microsoft 365, SEO, social marketing, Chrome devices, IT support, consulting, and custom app development.

2. Service Provision

Momtaz ICT provides services both directly (on our own servers and systems) and as an authorized reseller or agent for third-party providers (including GoDaddy, Google, Microsoft, and others). For certain services, you may also be subject to the terms, conditions, and privacy policies of these third-party providers. In the event of any conflict between our terms and the third-party's terms, the third-party terms will control for those specific services.

3. Account Registration and Payment

- You must create an account and provide accurate, up-to-date information.
- You must add a valid payment method (credit card, debit card, PayPal, e-transfer, or other methods available on our website at the time of purchase) to your account for payment processing.
- You authorize Momtaz ICT to automatically charge your payment method for all subscription services, renewals, recurring fees, taxes, network fees, and administrative fees related to your services.
- All services—including but not limited to domain registration, web hosting, and email services—are set to auto-renew at the current price in effect at the time of renewal, unless you notify us in writing (including via email or your online account) at least seven (7) days prior to the renewal date.
- It is your responsibility to check current pricing before renewal. We are not required to notify you of price changes.
- Payments are processed via third-party providers (such as Stripe, PayPal, or others available in your region), and by using these payment methods, you agree to their terms and privacy policies in addition to those of Momtaz ICT.
- Customers are responsible for all applicable taxes, network fees, and administrative fees related to their services. These fees may vary by service and region.

Failed Payments:
If a payment attempt fails, Momtaz ICT will retry the payment a reasonable number of times. If payment is not received within a reasonable period, your services may be suspended or terminated at our discretion.

4. Refund Policy

- For Momtaz ICT direct services, you may request a refund within fourteen (14) days of purchase or renewal.
- For third-party or resold services (such as Google Workspace, Microsoft 365, or GoDaddy products), the refund policy of the actual service provider applies. Momtaz ICT does not guarantee refunds for such services, and all requests are subject to the respective provider's policies.
- Refunds are not offered for accounts terminated due to violation of these Terms or for services terminated for abuse, fraud, or other breaches.

5. Automatic Renewal and Cancellation

- All eligible services are set to auto-renew at the then-current price.
- To cancel auto-renewal, you must notify us at least seven (7) days prior to the renewal date in writing or through your account dashboard.
- If you fail to provide timely notice, your service will be renewed and you will be charged accordingly.
- If you request a refund for an automatically renewed service, our standard refund policy applies.

6. Service Uptime

Momtaz ICT strives to provide at least 99.9% uptime for our hosting and cloud services, excluding scheduled maintenance, emergency repairs, customer-caused issues, or events beyond our reasonable control. No compensation or guarantee is provided for downtime caused by third-party failures, force majeure, or your actions.

7. Acceptable Use Policy

You agree not to use our services for unlawful, abusive, harassing, infringing, or fraudulent activities, including but not limited to sending spam, hosting malware, violating intellectual property, or distributing illegal content.

We reserve the right to investigate suspected violations and suspend or terminate your services at our sole discretion if we believe you have breached this policy.

You are responsible for any activity under your account, whether authorized by you or not.

8. Security and Malware Protection

We may automatically scan, quarantine, or remove files on your hosting or email accounts if they are detected as suspicious or malicious.

Suspicious files may be submitted to our trusted security partners (e.g., Imunify, CloudLinux, or similar) for malware analysis. All files are handled securely and in compliance with applicable privacy laws.

By using our services, you consent to this security and malware scanning, which helps protect your account and our infrastructure.

9. Data Retention & Backup Policy

Backups are only provided to customers who have purchased backup service or where backups are specifically included in their hosting package.

If you do not have an active backup service with us, you are solely responsible for maintaining your own backups of data and content.

If you request backup restoration for any reason other than a fault caused by Momtaz ICT, you agree to pay the current backup retrieval or restoration fee as set by Momtaz ICT.

Momtaz ICT is not liable for any data loss, corruption, or inability to restore data, whether or not you have purchased backup services.

10. Intellectual Property

Unless otherwise agreed in writing, all intellectual property and proprietary materials provided by Momtaz ICT (including software, code, designs, documentation, and platforms) remain the exclusive property of Momtaz ICT.

Upon full payment, custom websites or applications developed for you become your property, excluding any third-party or pre-existing components.

You grant Momtaz ICT a license to use your content as necessary to provide the services.

11. Third-Party Services Disclaimer

Momtaz ICT is not responsible for disruptions, errors, or failures in third-party services, platforms, or providers. Your use of such services is governed by their respective terms and policies.

12. Updates, Maintenance, & Emergency Changes

Momtaz ICT reserves the right to perform scheduled or emergency maintenance, updates, or changes to its services and infrastructure at any time.

We will use reasonable efforts to notify customers in advance of planned maintenance, but some interruptions may occur without notice.

13. Force Majeure

Momtaz ICT is not liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, labor disputes, major network or Internet outages, hacking or cybersecurity incidents (despite all reasonable precautions and security best practices), or third-party service failures.

While we take all reasonable steps to protect our infrastructure and your data, some risks (including sophisticated hacking) cannot be completely avoided.

14. Right to Refuse or Terminate Service

Momtaz ICT reserves the right to refuse, suspend, or terminate service to any customer at its sole discretion and without prior notice, including but not limited to cases of actual or suspected abuse, fraud, illegal activity, or violation of these Terms.

In such cases, the customer remains responsible for paying all outstanding or remaining balances for the contracted service term, and no refunds will be issued for any portion of the service already paid or remaining.

15. Communications Consent

By using our services, you consent to receive service-related communications, invoices, notices, and occasional promotional messages from Momtaz ICT.

You may opt out of non-essential marketing emails at any time.

16. Limitation of Liability

To the maximum extent permitted by law, Momtaz ICT shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including loss of data, business interruption, or lost profits.

Our total aggregate liability for any claim shall not exceed the total fees paid by you for the service in question over the previous twelve (12) months.

17. Indemnification

You agree to indemnify and hold harmless Momtaz ICT, its affiliates, employees, and partners from any claims, damages, or losses arising out of your use of the services, violation of this Agreement, or infringement of any third-party rights.

18. Dispute Resolution, Governing Law, and Severability

Any dispute or claim arising out of or relating to these Terms or our services shall be resolved by binding arbitration in accordance with the laws and rules of the Province of British Columbia, Canada.

You waive the right to participate in class actions and agree to bring claims individually.

This Agreement is governed by the laws of the Province of British Columbia and the laws of Canada. If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

19. Entire Agreement & Waiver

These Terms constitute the entire agreement between you and Momtaz ICT. No waiver of any term is effective unless in writing.

Failure to enforce any part does not waive our right to enforce it later.

20. Changes to Services or Terms

Momtaz ICT reserves the right to modify, suspend, or discontinue any service or feature at any time, with or without notice.

We may update these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the revised terms. The most current version will always be available on our website.

21. Privacy Policy

Our Privacy Policy, available on our website, describes how we collect, use, and protect your information. By using our services, you consent to our data practices as described in the Privacy Policy.
